CHAPTER 7

Chapter 7 also referred to as straight or simple bankruptcy is when you will be able to discharge all of your unsecured debts under the bankruptcy code.  You will never have to pay these debts back and creditors will not be allowed to collect on these debts once you receive your discharge.  Chapter 7 is also referred to as a liquidation bankruptcy because the bankruptcy trustee may liquidate some of your assets, but there are exemptions to protect most assets, so this is generally not a problem.

CHAPTER 13

Chapter 13 is available for those who make too much money for Chapter 7 or need to file to save their homes or cars.  Under Chapter 13 you can stop a foreclosure on your home.  You will have three to five years to pay under a Chapter 13.  At the end of the case you will not owe any of your unsecured debts and creditors will not be able to collect on debts which were discharged through the case.  Chapter 13 is also referred to as a wage earner plan as you must have the income to support the case.
